CHARLES, UNKNOWN SPOUSE OF DAYLON KYLE HURST; LINDA SUTTON; AND ALL OTHER PERSONS CLAIMING ANY INTEREST IN THE LANDS AND ESTATE OF MARY JANE CHILDERS WELCH, BY AND THROUGH THEIR GUARDIAN AD LITEM, JONATHAN C. MATTOX, ESQ.:
TAKE NOTICE that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is to enjoin the Defendants, or others claiming any right of possession through the Defendants, from occupying, living in, residing in and/or using the improvements, including but not limited to the plumbing, toilets, sinks, water system and/or ground absorption sewer treatment and disposal system located upon said lands owned, occupied and/or controlled by the Defendants, until such time as the property has a fully approved and duly permitted ground absorption sewer treatment and disposal system located upon the property or is otherwise duly connected to an approved sewer system; and enjoin the Defendants, or others claiming any right of possession through the Defendants, from using the ground absorption sewage treatment and disposal system upon the lands owned, occupied and/or controlled by the Defendants in violation of the operation and maintenance requirements of Title 15A, Chapter 18, Subchapter 18A, Section .1961 and the provisions of N.C. Gen. Stat. §130A-335(a).
You are required to make defense to such pleading not later than forty (40) days after April 10, 2024 and upon your failure to do so the party seeking service against you will apply to the Court for the relief sought.
